What is the DMCA?
The DMCA (Digital Millennium Copyright Act) establishes legal protections for internet service providers (ISPs) that host third-party content by providing a notice-and-takedown procedure for copyright infringement claims. This ensures that platforms like Email Donut, which aggregate publicly available marketing emails, can operate legally while addressing copyright concerns in compliance with the law.
DMCA Takedown Notices
Filing a DMCA complaint initiates a legal process that allows copyright holders to request the removal of allegedly infringing content. The DMCA also provides a counter-notice process, which allows users to challenge a takedown if they believe the content was removed in error.
Procedure for Reporting Copyright Infringement

Identification of the Infringing Material:
A direct link (URL) to the content hosted on Email Donut that you believe infringes your copyright
Sufficient detail for us to locate and verify the material
A Statement of Good Faith Belief:
"I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."
A Statement of Accuracy:
"I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
Your Signature:
A physical or electronic signature (typing your full name will suffice).Upon receiving a valid DMCA request, we will review the claim and take appropriate action, which may include removing or restricting access to the content in question.
How We Handle DMCA Notices
If the DMCA notice is incomplete, we will notify the sender that we cannot process the request.
If the DMCA notice is complete and valid, we will:
- Remove or disable access to the allegedly infringing material.
- Notify the user who uploaded or submitted the content.
- Allow the user to submit a DMCA counter-notice if they believe the removal was a mistake.
Counter-Notification Process
If you believe your content was wrongfully removed, you may submit a Counter-Notification to khaled@emaildonut.com with the subject line: DMCA Counter-Notice.
Your counter-notice must include:
Your Contact Information (Same as above).
Identification of the Removed Material (Include the URL of the removed content).
A Statement of Good Faith Belief:
"I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification."
Consent to Jurisdiction:"I consent to the jurisdiction of the federal court in my district and agree to accept service of process from the person who provided the original DMCA notice or their agent."
Your Signature (Electronic or physical).Once we receive a valid counter-notification, we will forward it to the original complainant. If they do not file a lawsuit within 10 business days, we may restore the removed content.
Repeat Infringers Policy
We reserve the right to terminate access to any user or entity that repeatedly submits infringing content.
Abuse Notification & Misuse of the DMCAAbusing the DMCA notice process by submitting false or misleading claims can result in legal liability under 17 U.S.C. § 512(f), which allows courts to award damages, court costs, and attorney fees to those harmed by fraudulent notices. If we determine that a takedown request was submitted fraudulently, we reserve the right to deny future claims from the sender.These notice and takedown procedures apply only to copyright infringement claims. Any other legal claims must be handled separately.
