Welcome to Email Donut. By accessing or using Email Donut, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the service.

1. About Email Donut

Email Donut is a business to business software platform that provides email marketing inspiration, marketing calendar creation, and related tools. The service may connect with third party platforms such as Shopify and Klaviyo and may use artificial intelligence to generate scores, insights, and calendars.

2. Eligibility and Accounts

You must create an account to access most features. Some features are available for free, while others require a paid subscription.

You are responsible for maintaining account security and for all activity under your account. Accounts may be created using email and supported authentication providers such as Google through Firebase.

We may suspend or terminate accounts that engage in abuse, misuse, excessive scraping, attempts to bypass paywalls, or activity that interferes with the service.

3. Subscriptions and Payments

Paid features require an active recurring subscription. All fees are non refundable unless required by law.

Payments are processed through providers such as Stripe. We do not store full payment details.

4. Data, User Content, and Data Protection

4.1 Data Ownership

You retain ownership of all data connected from Shopify, Klaviyo, or other platforms. Email Donut does not claim ownership of that data.

4.2 License to Process Data

By using the service, you grant Email Donut permission to process connected data to provide features and improve the product, including artificial intelligence models, limited to the purposes described in this agreement and our Privacy Policy.

4.3 Data Minimization

We process only the minimum personal data required for stated functionality.

4.4 Protected Customer Data

Where protected customer data is accessed through Shopify or other platforms, we comply with all applicable data protection requirements and make Data Protection Agreements available upon request.

4.5 Customer Consent and Opt Out

We respect customer consent decisions, including marketing opt in or opt out preferences and data sharing opt out rights under applicable laws such as CPRA and GDPR.

4.6 Automated Decision Making

If automated decisions could have legal or similarly significant effects, individuals may request manual processing by contacting support@emaildonut.com.

4.7 Data Retention

Personal data is retained only as long as necessary and securely deleted or anonymized when no longer required.

4.8 Data Protection Agreement

Data protection agreements are available upon request at support@emaildonut.com.

5. Artificial Intelligence Features

AI generated outputs are for informational and creative purposes only. They may be inaccurate or incomplete. You are responsible for reviewing and deciding how to use any output.

6. Email Sending

Email Donut may send service related notifications. Marketing campaigns are not sent on your behalf unless explicitly enabled by you.

7. Third Party Services

Integrations such as Shopify, Klaviyo, Stripe, and OpenAI are subject to their own terms. We are not responsible for outages or changes caused by third parties.

8. Acceptable Use

• Use the service for unlawful purposes
• Attempt to reverse engineer or scrape the platform
• Abuse rate limits
• Interfere with system security
• Access data beyond authorized scope

9. Security

We implement encryption in transit and at rest, strict environment separation, role based access controls, logging, and incident response procedures. Full details are described in our Privacy Policy.

10. Changes to the Service

We may modify or discontinue features at any time without liability.

11. Disclaimers

The service is provided as is and as available without warranties of any kind.

12. Limitation of Liability

Our total liability will not exceed the amount paid to Email Donut in the twelve months prior to the claim.

13. Indemnification

You agree to indemnify Email Donut from claims arising from your use of the service or violation of these terms.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada.

15. Changes to These Terms

We may update these Terms from time to time. Continued use after updates constitutes acceptance.
